Terms & Conditions
Please read these terms carefully before using the TicketBlaze platform. By accessing our services, you agree to be bound by these conditions.
Last updated: 24 April 2025 · Effective immediately
1. Acceptance of Terms
By accessing or using the TicketBlaze platform available at ticketblaze.co.ke (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.
These Terms constitute a legally binding agreement between you and TicketBlaze ("we", "our", or "us"). We reserve the right to update these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
If you are accessing the Platform on behalf of an organisation or business, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility
You must be at least 18 years of age to create an account or purchase tickets on the Platform. By using TicketBlaze, you represent and warrant that:
• You are at least 18 years old, or that you are accessing the Platform under the supervision of a parent or legal guardian who agrees to these Terms.
• You have the legal capacity to enter into a binding agreement.
• All registration information you submit is accurate, current, and complete.
• You will maintain the accuracy of such information and update it as necessary.
3. User Accounts
To access certain features of the Platform, you may be required to register for an account. You are responsible for:
• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately at support@ticketblaze.co.ke of any unauthorised use of your account.
We reserve the right to suspend or terminate your account at our discretion if we suspect a breach of these Terms, fraudulent activity, or conduct that we determine to be harmful to other users, organisers, or the Platform.
You may not transfer your account to another person or use another person's account without permission.
4. Ticket Purchases
When you purchase a ticket through TicketBlaze, you are entering into a transaction with the event organiser, not with TicketBlaze directly. TicketBlaze acts as a technology platform facilitating the sale of tickets on behalf of organisers.
4.1 Payment: All payments are processed securely. Ticket prices are displayed in Kenyan Shillings (KES) unless otherwise stated. You agree to pay all charges at the prices listed at the time of purchase.
4.2 Order Confirmation: A confirmation email will be sent to your registered email address upon successful purchase. This email serves as your proof of purchase.
4.3 Ticket Delivery: Tickets are delivered electronically via email or accessible through your TicketBlaze account. It is your responsibility to present a valid ticket at the event.
4.4 Ticket Validity: Tickets are valid only for the specific event, date, time, and seat (where applicable) stated on the ticket. TicketBlaze accepts no responsibility for tickets that are lost, stolen, or rendered invalid due to resale on unauthorised platforms.
4.5 Pricing Errors: In the event of an obvious pricing error, we reserve the right to cancel any orders placed at the incorrect price and offer you the option to purchase at the correct price.
5. Refunds and Cancellations
5.1 Organiser-Led Refunds: Refund policies are set by individual event organisers and will be displayed on the event listing page. TicketBlaze is not responsible for refund decisions made by organisers.
5.2 Event Cancellation: If an event is cancelled by the organiser, TicketBlaze will facilitate a full refund of the ticket face value to the original payment method. Service fees charged by TicketBlaze may not be refundable.
5.3 Event Postponement: If an event is postponed, your ticket will typically remain valid for the rescheduled date. If you cannot attend the rescheduled event, refund options will depend on the organiser's policy.
5.4 Platform Service Fees: TicketBlaze's platform and processing fees are non-refundable except where required by applicable Kenyan law.
5.5 Chargebacks: Initiating an unjustified chargeback with your bank may result in account suspension and potential recovery action.
6. Event Organisers
If you use TicketBlaze to list and sell tickets for events ("Organiser"), you agree to the following additional obligations:
6.1 Accuracy: All event information — including date, time, venue, ticket prices, and descriptions — must be accurate and kept up to date. You are solely responsible for any errors or omissions.
6.2 Event Delivery: You are responsible for delivering the event as advertised. In the event of cancellation or material changes, you must promptly notify TicketBlaze and affected attendees.
6.3 Compliance: You agree to comply with all applicable Kenyan laws, including those relating to public gatherings, entertainment licensing, health and safety regulations, and taxation.
6.4 Payouts: TicketBlaze will remit collected ticket proceeds to you according to the agreed payout schedule, less applicable platform fees. Payouts may be withheld if we suspect fraud or a breach of these Terms.
6.5 Prohibited Events: You may not list events that promote illegal activity, hate speech, discrimination, or content that violates any applicable law or TicketBlaze's content guidelines.
7. Prohibited Conduct
You agree not to engage in any of the following activities on the Platform:
• Using the Platform for any unlawful purpose or in violation of any regulations.
• Attempting to gain unauthorised access to any part of the Platform or its systems.
• Reselling or transferring tickets in violation of an organiser's stated policy.
• Using bots, scrapers, or automated tools to access or interact with the Platform.
• Posting false, misleading, or deceptive content.
• Harassing, threatening, or abusing other users, organisers, or TicketBlaze staff.
• Attempting to manipulate ticket availability, pricing, or waitlists.
• Circumventing or attempting to circumvent any security features of the Platform.
Violation of these prohibitions may result in immediate account termination and potential legal action.
8. Intellectual Property
All content on the TicketBlaze Platform — including but not limited to logos, text, graphics, software, and the Platform's design — is the intellectual property of TicketBlaze or its licensors and is protected under Kenyan and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for its intended purposes. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.
By submitting content to the Platform (such as event descriptions, images, or logos), you grant TicketBlaze a worldwide, royalty-free licence to use, display, and distribute that content in connection with operating and promoting the Platform.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at ticketblaze.co.ke/privacy to understand our data practices.
By using the Platform, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by applicable Kenyan law, TicketBlaze shall not be liable for:
• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Loss of data, profits, goodwill, or any other intangible losses.
• Any acts or omissions of event organisers, including event cancellations, changes, or failure to deliver the event as advertised.
• Any technical failures, interruptions, or errors affecting the Platform.
• Unauthorised access to or alteration of your data.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount paid by you through the Platform in the twelve (12) months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Disclaimers
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
TicketBlaze does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not endorse or take responsibility for the content, accuracy, or quality of events listed by organisers.
Any reliance you place on information provided through the Platform is strictly at your own risk.
12. Indemnification
You agree to indemnify, defend, and hold harmless TicketBlaze, its directors, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
• Your use of the Platform.
• Your breach of these Terms.
• Your violation of any applicable law or third-party rights.
• Any content you submit to the Platform.
• Your conduct as an event organiser.
13. Third-Party Services
The Platform may integrate with or link to third-party services, including payment processors, mapping services, and social media platforms. TicketBlaze is not responsible for the practices, content, or availability of any third-party services.
Your interactions with third-party services are governed by their respective terms and privacy policies. We encourage you to review these before providing any personal information to third parties.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties.
If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
15. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, to the extent permitted by applicable law.
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to sections on intellectual property, indemnification, disclaimers, and limitation of liability.
